General terms and conditions for the online shops
of the SkiWelt Wilder Kaiser – Brixental

 1. Preamble

            1.1.   The following companies: Bergbahn Brixen AG, Bergbahnen Wilder Kaiser GmbH, Bergbahnen Ellmau-Going GmbH & Co Astbergbahn KG, Bergbahnen Hohe Salve GmbH & Co KG Hopfgarten – Itter – Kelchsau, Bergbahn Scheffau GmbH & Co KG, Berg- und Skilift Hochsöll GmbH & Co KG and Bergbahnen Westendorf GmbH together form the “SkiWelt Wilder Kaiser – Brixental” in winter and, in summer, jointly present the “Wilder Kaiser – Brixental summer cable cars and lifts” offer. These companies are hereinafter jointly referred to as “SkiWelt”.

            1.2.   The following sales offers are available:

a)      Tickets (ski passes or cable car and lift tickets): these can only be purchased online by entering a specific period that must always be selected in advance by the customer when purchasing online via the SkiWelt ticket shop.

b)     Vouchers with no time limit: e.g. vouchers, cable car adventure offers with a defined value. To be purchased via the SkiWelt voucher shop.

c)      Vouchers with a time limit: e.g. events with a specific date and time and a limited period of use. To be purchased via the SkiWelt voucher shop.

d)     Products: tangible products such as key rings or tube scarves. To be purchased via the SkiWelt voucher shop.

 2. Conditions of purchase

                     2.1.   The contract is concluded with SkiWelt Wilder Kaiser – Brixental Marketing GmbH.

              2.2.   Tickets/vouchers/products may be ordered by persons aged 18 years and over.

              2.3.   The orders (tickets/vouchers/products) remain the property of SkiWelt until they have been paid for in full and are only valid after the full purchase price has been received. SkiWelt also reserves the right to block the validity of the tickets/vouchers in the context of automated processing.

              2.4.   All prices for cable cars and lift services, whether tickets or vouchers, include 10% VAT. Vouchers are only activated once they are redeemed, with the corresponding amount is then taxed at 10%. Product prices include 20% sales tax.

              2.5.   Only individual tariffs are offered in the online shop. Special offers and group rates are not available from the online shop: they are only available in person, with appropriate proof of entitlement, at the ticket offices of the valley stations of the access-level cable cars and lifts. The SkiWelt access cable cars are the Cable Car Brixen Liftweg1 6364 Brixen im Thale, Cable Car Ellmau, Weissachgraben 5 6352 Ellmau, Cable Car Going Marchstrasse 53 6353 Going, Cable Car Hopfgarten Meierhofgasse 29 6361 Hopfgarten, Cable Car Itter Alte Bundesstrasse 1 6355 Itter, Cable Car Scheffau Schwarzach 2, 6355 Scheffau, Cable Car Söll Stampfanger no. 21 6306 Söll, and Cable Car Westendorf Bergliftstrasse 18 6363 Westendorf.

              2.6.   Purchased or ordered tickets/vouchers are to be used in the form of the services offered by SkiWelt and cannot be redeemed for cash.

              2.7.   The content and scope of services are delineated by the services listed on the vouchers. Additional and extraordinary services will be listed separately on the voucher insofar as the purchaser is entitled to these.

              2.8.   Vouchers can only be redeemed at the ticket offices of the valley stations of the access-level cable cars (see point 2.5.).

              2.9.   The data provided is processed automatically. Purchasers are obliged to submit full and correct data when ordering. Should such data prove incorrect, incomplete or unclear, the purchaser will be liable for all costs, damage and prejudices arising therefrom. We reserve the right to press criminal charges.             

3. Validity

      3.1.   Validity according to type

a)      Tickets: tickets are valid for the booked period and must be redeemed during this period. In the case of paid tickets that could not be redeemed at the time of booking, the customer will retain the monetary value. In this case the customer must exchange the unredeemed ticket at one of the specified SkiWelt cable car ticket offices, with any surcharge payable directly to the office. No redemption for cash is possible.

b)     Vouchers with no time limit are valid for three years from the date of purchase and must be redeemed during this period. Should seasonal price adjustments occur during this period, the difference is to be paid on the valid package price if the scope of services changes in type and quality. The difference is payable at the access-level cable cars mentioned at point 2.5.

 

c)      Vouchers with a time limit must be redeemed within the specified period. If the voucher cannot be redeemed within the specified period, the value of the voucher will be retained for three years from the date of purchase and can be credited towards other SkiWelt tickets or SkiWelt products at the ticket offices mentioned at point 2.5.

 

                            3.2.   Unused days will not be reimbursed, replaced or credited once a ticket has first been used, i.e. when the holder first passes through a turnstile with the ticket then activated. In the event of accident, please see the SkiWelt tariff guidelines.

          4. Order costs, delivery conditions

                   4.1.   Tickets/vouchers/products may be paid for by direct debit or by credit card (Visa, Mastercard).

          4.2.   Vouchers can be downloaded and printed out directly after purchase and will also be sent to your mailbox via e-mail (delivery method: “Download and immediate delivery via e-mail”). No order charge is made.

          4.3.   Tickets can be uploaded directly onto an existing KeyCard (order type: “Top up KeyCard”). No order charge is made. Tickets can be used one hour after ordering.

          4.4.   Tickets can also be sent by post. Postal delivery times must be taken into account (approx. 3-5 working days in Germany, 8-10 working days abroad).

          4.5.   No liability is accepted for late postal deliveries.    

5. Revocation, returns, repayment, residual value

5.1.   Revocation:

a)      Tickets: purchased tickets may be revoked without cause within 14 calendar days from the date of conclusion of the contract, provided they have not been used or activated: a declaration of revocation is sufficient. Keep your ticket if for whatever reason you do not wish to use it during the booked period but rather at a later date: our service team at the SkiWelt ticket office of your choice will perform this service for you on the spot.

b)     Vouchers with no time limit: vouchers may be revoked without cause within 14 calendar days from the date of conclusion of the contract, provided they have not yet been partially or fully redeemed or cancelled: a declaration of revocation is sufficient.

c)      Vouchers with a time limit: vouchers may be revoked without cause within 14 calendar days from the date of conclusion of the contract, provided they have not yet been redeemed or cancelled: a declaration of revocation is sufficient.

d)     Products: the withdrawal period is 14 calendar days starting on the day upon which the last goods were received: a declaration of revocation is sufficient.

5.2.   Revocation is only possible under the above conditions (point 5.1.) and only at the purchaser’s express request to SkiWelt. A registered letter must be sent to the SkiWelt Marketing Office for this purpose.
5.3.   Returns:

a)      Tickets: the value of the deposit on the KeyCard is non-refundable, as the card remains in the purchaser’s possession. Existing KeyCards may be used for additional top-ups.

b)     Vouchers with no time limit: vouchers are sent via the “Download and immediate delivery via e-mail” method and do not need to be returned.

c)      Vouchers with a time limit: vouchers are sent via the “Download and immediate delivery via e-mail” method and do not need to be returned.

d)     Products: goods must be returned immediately, and no later than 14 calendar days from the date of submitting the declaration of withdrawal, to SkiWelt Wilder Kaiser – Brixental Marketing GmbH, Dorf 84, 6306 Söll, Austria.

5.4.   Refunds:

a)      Tickets: the monetary amount of refunds will be credited to the customer account of the ticket shop.

b)     Vouchers with no time limit: for all repayments, the same means of payment will be used as that used for the original transaction, unless a different method has been expressly agreed.

5.5.   In the event of a chargeback of the monetary amount to a credit card or bank account, SkiWelt will, without exception, make a proportionate charge of EUR 5.00 per ticket transaction and product booking for the costs of technical transactions, service fees and processing. This sum will be charged/deducted in the course of the reimbursement. For season tickets we charge a flat-rate service and processing fee of EUR 15.00 per ticket transaction.
5.6.   If the value redeemed for a voucher is less than the value of the voucher, the remaining value will remain on the voucher.

6. Security guarantee & data protection

6.1.   Your security has top priority! Data such as credit card numbers, bank codes, account numbers, or names and addresses are therefore transmitted via a protected SSL line. This prevents any unauthorised persons from reading the data that you enter while these are being sent over the internet. In order to ensure security in the ticket/voucher shop, we use a number of additional security measures that meet the current security standards for cashless payment transactions.
6.2.   All data are processed in accordance with the General Data Protection Regulation (GDPR). All information on data protection can be found at www.skiwelt.at/data-protection.
6.3.   All data will be processed by ourselves with the assistance of automated systems. You will only receive advertising information from the shop operator in this regard unless you expressly object to this immediately or at the latest within a period of fourteen days after the shop operator has notified you of this. No personal or person-related data will be disclosed to third parties unless these are required for processing (postal delivery).
